New Jersey has a program called pretrial intervention, or PTI, generally for first-time offenders. The benefits of participating in this program can be tremendous. Essentially, if you qualify for the program, are accepted and complete it, the charges will be dismissed, thereby eliminating any record of conviction. Six months after a dismissal, you will be eligible to get the arrest expunged.
Who can apply for PTI? Any adult defendant who is charged with an indictable offense may apply for this program. As a general rule, PTI excludes defendants with prior convictions as well as defendants who are charged with a first- or second-degree criminal offense. If your application is denied, you may appeal the decision to the Presiding Judge of the Criminal Division.
If accepted, conditions attached to your participation in the program will include a term of probation from one to three years; random urine monitoring; and assessments for fees, penalties and fines. The successful applicant may also be required to perform community service, pay restitution and submit to psychological and/or drug and alcohol evaluations and comply with recommended treatment programs.
