There are many situations that require a parent to relocate, such as a new job or remarriage. No matter what the reason, I will help you seek a modification in your child custody agreement that is conducive to supporting a healthy relationship for your child with both parents.
There are jurisdictional and out-of-state child custody issues to consider, such as whether New Jersey or the relocation state has jurisdiction over the matter. In general, New Jersey maintains jurisdiction except if:
- The child has been out of state for an extended period of time.
- There have been no proceedings the state has been involved in (i.e., child custody modification, child support, enforcement, etc.)
- Both parents have left New Jersey since the original court proceedings establishing custody.
What is almost universal is that the courts (whether in New Jersey or elsewhere) will make a determination on relocation and move-away issues by examining the motivations of the parent requesting the move; the ability of maintaining a healthy relationship with the other parent, the best interests of the child and, depending on the age, the child's preference. As a general rule, relocation is not allowed during the child's senior year of high school.
